Terms of Service
Effective: May 8, 2026
These Terms govern your use of PostChamp at trypostchamp.com and the customer portal (the “Service”). By signing up, you agree to them. If you don’t agree, don’t use the Service. Plain English below; email hello@trypostchamp.com with questions.
1. Who can use PostChamp
You must be a legal business operator (or authorized agent of one) at least 18 years old. You’re responsible for the accuracy of the information you give us, including your business name, contact info, and license details where applicable.
2. What we do
We help contractors run AI-personalized direct-mail postcard campaigns. For each campaign you run, we:
- Take an address list (yours, or one we curate from your zip + filter criteria)
- For each address, fetch a publicly-available street-level photo of the property
- Generate an AI rendering of that property with your service applied
- Render a postcard using your branded template, print it, and mail it via USPS
3. What you do
You agree to:
- Provide accurate brand assets, contact info, and (if applicable) license information for use on postcards
- Only mail to lists you have a legal right to mail to (USPS-compliant marketing addresses, no purchased opt-out lists, etc.)
- Not use the Service for fraudulent, deceptive, illegal, discriminatory, or harassing campaigns
- Not market products or services that violate USPS or state regulations (firearms, controlled substances, certain financial products without proper licensing, etc.)
- Comply with the CAN-SPAM Act, state direct-mail regulations, and any contractor-licensing rules in the states you operate in
You’re solely responsible for the legality and accuracy of the content you send through PostChamp.
4. Pricing and payment
Pricing is per-campaign, all-in (print + mail + AI rendering + postage), at the rates posted on trypostchamp.com/#pricing. The price for each campaign is locked when you create it and appears in your portal.
Payment is collected up-front via Stripe before any sample renders fire. Campaigns are non-refundable. If something goes wrong on our end (mail not delivered, print quality issue, etc.), we’ll work with you on a fix — typically a re-mail at our cost.
5. Sample approval and revisions
After you pay, we render a small batch of sample postcards showing real homes from your list with your service applied. You review them in the portal and either approve or request changes. Revisions during this stage are unlimited; nothing prints until you approve.
6. Mailing windows and delivery
Once you fire production, postcards typically enter the USPS mail stream within 5–7 business days, with most delivered to homeowner mailboxes within 4–7 business days after that. Exact timing depends on USPS — we don’t guarantee delivery dates and aren’t responsible for USPS delays.
7. Address list ownership
- Lists you upload remain yours. We use them only to fulfill your campaigns and for the operational purposes described in our Privacy Policy.
- Curated lists we generate for you (when you opt for the curated tier) are yours to use within PostChamp. We retain our curation methodology and the underlying data sources.
8. Intellectual property
- You retain ownership of your brand assets (logo, copy, colors, etc.). You grant us a license to use them solely to render and print postcards for your campaigns.
- The PostChamp platform, postcard templates, render prompts, and generated imagery are ours. The right to use the rendered postcard images is exclusive to your campaign; we don’t resell or repurpose them.
9. Acceptable use
You agree not to:
- Mail to addresses without a legitimate marketing purpose
- Impersonate another business or service
- Use AI-generated property imagery to mislead recipients about the actual condition or features of their property
- Reverse-engineer, scrape, or attempt to access non-public parts of the Service
- Resell or sublicense the Service to third parties without our written agreement
We can suspend or terminate accounts that violate this clause.
10. Service availability
We aim for high availability but don’t guarantee uptime. Background jobs (rendering, mail submission) are designed to retry on transient failures. If a campaign is materially delayed because of a Service outage, we’ll work with you on a fix — typically a re-mail at our cost or a partial credit.
11. Disclaimers
The Service is provided “as is.” We don’t guarantee specific business outcomes — direct mail response rates depend on many factors outside our control (your offer, the market, your follow-up). Any pricing, response-rate, or ROI examples on the marketing site are illustrative, not contractual.
12. Limitation of liability
To the maximum extent allowed by law, our total liability for any claim arising out of the Service is capped at the amount you paid for the campaign(s) giving rise to the claim in the 12 months before the claim. We aren’t liable for indirect, consequential, or lost-profit damages.
13. Indemnification
You agree to indemnify PostChamp against claims arising from your campaigns — including content you provide, the legality of your mailing list, and disputes with recipients about your marketing.
14. Termination
You can stop using the Service or close your account anytime. We can suspend or terminate accounts for non-payment, abuse, or violation of these Terms. On termination, in-flight campaigns finish (unless we believe they violate law) and access to the portal ends.
15. Governing law
These Terms are governed by the laws of the State of New Jersey (where PostChamp is operated), without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in New Jersey.
16. Changes to these Terms
We may update these Terms as the product evolves. Material changes will be flagged via email to active customers and the effective date at the top of this page will change. Continued use after a change means you accept the updated Terms.
